This conversation was recorded before the Lindsay Clancy jury reached an impasse. We now know the jury ultimately deadlocked 11–1 in favor of acquittal, leading the judge to declare a mistrial.

That makes this discussion with Nico LaHood even more fascinating in hindsight.

LaHood — a former Bexar County District Attorney who now works as a defense attorney — examines the Clancy case from both sides of the courtroom. He explains how he would have approached the prosecution, how he would have defended Clancy, the strengths and weaknesses facing each side, and the questions jurors were likely wrestling with as they deliberated.

Joe Pags and Nico also dig into the legal strategy, the evidence, the defense’s case, and what could happen next if prosecutors decide to try Lindsay Clancy again.

Now that we know the jury came within one vote of acquittal, listen back to this conversation and hear the case through the eyes of someone who has sat on both sides of the courtroom.
